TYC Guard Testified Against Clinton

Statement From Clinton 

 

            A Common theme amongst all TYC guards that testified in my trial is how dangerous the unit I was in, was. This was a government operated facility, that they control. Yet it is very violent? The question is; why does the government allow this rampant violence?

 

            Myself and Ms. Timmons did not ever get along. Very few if any, enjoyed her presence. She was the kind of guard that felt as if her position afforded her some type of power and thus abused it.

 

            In her testimony she mentions an incident with a chair. I am at fault for that! The way it happened was, I was setting up the chairs and had picked a staff chair for myself to sit in, as it offers more comfort then the standard chairs inmates had to sit in. Most guards never bothered me when I picked this type of chair to sit in.

 

            Ms. Timmons made a big ordeal about it. I got upset, turned around, picked up the chair real fast, to make it clear that I was aggravated. I picked it up above my head and acted like I was going to throw it across the dorm. I DID NOT even have it positioned in her direction, nor did I throw it. I just slammed it to the ground roughly and pushed it across the floor and said “Take that stupid chair!” I did not push it in her direction as I knew I would get sent to security if I did.

 

            I know that I should have handled the situation in a calmer manner. Since I did not, I put myself in that position for her to make it something that is was not.

 

            In concern of the fight where she claims that she was assaulted, she was not hit. I was actually assaulted by her! As when she went to break up the fight, she spilled hot coffee all over me. The result that day was the result of a conflict between myself and another youth, over some eggs!

 

            A guy names Micheal didn’t eat eggs. I was sitting across from him and it was already understood between he and I, that he would give his eggs to me. (In TYC we do not get commissary)

 

            Another youth, named Richard decided to lay claim to them. I didn’t say anything about it, and just took the eggs. Richard was perceived as weak when he first arrived at TYC due to his desire to avoid conflict. So he had decided to become hyper-aggressive and get into a few conflicts. When he saw me get the eggs, he said “What’s up, that’s mine.” I responded with “I don’t think so,” and continued eating them. I guess he felt that since he had spoken out, he had to then make a move. I had just been promoted up a level for good behavior and was already over my time, I was supposed to have been there, so I wasn’t trying to get into a fight. Though in all honestly, I would not have given in, as that would have been taken as a sign of weakness.

 

            We left the chow hall, and went back to the dorm. While lining up to go to the educational building, Richard (who was at the front of the line) turned around and started heading towards me. (We lined up in three rows with eight in each line) When I saw him coming towards me, I could easily tell from his body language what was about to happen. So I started backing up. As I backed up, I was taking off my jacket, and I said, “Dude, I ain’t trying to fight ya.” I got my jacket off and I repeated my statement as I continued to back up. He then rushed after me, so I leaned in and started to hit him. We got off the pavement onto a patch of grass that was wet. We were both swinging and sliding everywhere as it was very slippery.

 

            The officer over our dorm that day was Ms. Rhoads. Richard and I were of equal build, so we were both swinging very fast. Ms. Rhoads violated all establishment protocol and jumped right in, in the middle of us, and as a result, was indeed hit. I stopped swinging, Richard tried to run around her and get to me. As he came around her, I kicked at his head, Ms. Rhoads stuck her hand out and as a result my foot kicked her hand, breaking her finger. At this time, Ms Timmons who was working on dorm four delta, which is right beside the dorm I was on, came running in to help break up the fight.

 

            She as well violated protocol as she left the dorm unattended. They were supposed to stand back, order us to stop, and wait on security personnel to arrive. Security had a transport van. They call a “10-10” over the radio, to indicate a fight in progress and state the dorm location. They are only supposed to break up the fight if there are two staff present to break up the fight and one to monitor the rest of the inmates.

 

            Ms. Timmons ran up behind me with a paper cup of coffee in her hand, when she grabbed me, it spilled all over me. I screamed and pulled away from her. She had my shirt which now had hot coffee all over it, so I came out of my shirt. At this time, I saw that Richard had broken free from Ms. Rhoads and was running after me, so I ran after him.  Ms. Timmons tripped me and Ms. Rhoads was able to grab Richard again, by that time security personnel was there, and it was all over.

 

            At no time, did Ms. Timmons get hit. If she was hit, she would have put it in her written report. Assault on a staff member is an automatic extra year! An inmate is criminally charged and will receive another year of time to serve.

 

            I did not receive any charges, due to Ms. Rhoads taking up for me. She knew that I did not in any way intend to assault her. She received a broken bone and had to go to the hospital, so if she thought I intentionally hit her, I would have been charged. I never once apologized to Ms. Timmons, I had no reason to. If I had written her an apology letter, they would have had a copy of it. However I did write one to Ms. Rhoads. I did this on my own, and apologized to her for all that happened.

 

            Truth be told, the rules in TYC are that if an inmate goes to assault another inmate, the victim is supposed to ball up and wait on staff to restrain the offending youth. Call me what you will, but I am  not about to just ball up and wait on them to break it up, while I get hit or kicked on! It is extremely rare for a female officer to get assaulted. When she testified she was on work leave for TWO inmates attacking her at the same time, that happening to a female officer is unheard of!

 

            Ms. Rhoads was eventually fired from TYC after I left. We have been unable to locate her. I knew her first name, but that area of Texas was hit very badly by the hurricanes in recent years. So locating people from that area is very difficult.

 

            You will see from Ms. Timmons testimony and her report, that she lied in my trial. The point of her testifying against me was so that the prosecution could tell the jury that I would be a threat to prison staff. This would make me a danger and the only way to help protect staff would be to give me the death penalty. This is why Ms. Timmons lies are so heavy and harmful.

The following testimony is from Jacqueline Timmons. She was a guard for the Jefferson County State School now known as Al Price.

 

Ms. Timmons testified that Clinton assaulted her during her attempt at breaking up a fight that Clinton was in with another inmate.

 

At the trial the prosecutor and lawyers only focused on a summary report. This is a synopsis of the events that took place, that is entered into the security file system.

 

In T.Y.C solitary confinement is known as “Security.” Clinton’s attorney confronted Ms. Timmons about the fact that the summary report didn’t contain any information about her being hit. It only mentioned the other staff member, who did not testify against Clinton.

 

Ms. Timmons testified that in her actual report, she stated that she was hit by Clinton.

 

After Clinton was sent to death row, he received copies of the prosecutors file. In the file was a copy of Ms. Timmons written report from the fight. No where in her report does she state that she was hit by any youth involved in the fight. The prosecution possessed a copy of her report prior to her testimony. They knowingly allowed her to testify in a false manner to paint Clinton as a violent person.

 

The courts have repeated ruled that it is a violation of established law for a prosecutor to knowingly allow false testimony in any form or manner.

 

 Following Ms. Timmons Testimony, we have included a copy of Ms. Timmons handwritten report. It is not as clear as we would like, though we have included a separate explanation of what the statement says. Ms. Timmons false testimony is just one of many examples that prove that Clinton was wrongfully convicted and sentenced to death.
